Acceptable Use Policy

The terms used in this policy shall have the same meaning as defined in the unless defined otherwise.

Definitions

Authorized Users means the employees, agents and independent contractors of (i) the Customer; and (ii) the Customer’s affiliates or subsidiaries, who are authorized by the Customer to use the Services (as defined in the Terms of Service).

Acceptable use of the Platform by an Authorized User shall mean use which is not in excess of what would be reasonably expected by that Authorized User given the nature and responsibilities of their job and level of experience.

The Customer shall ensure each Authorized User maintains a secure password for use of the Services.

The Customer shall not access, store, distribute or transmit any Virus or any material during the course of its use of the Services that is unlawful, inappropriate or illegal. Pincites reserves the right, without liability or prejudice to its other rights, to disable the Customer’s account in relation to any breach or suspected breach of this policy. “Virus” means anything or device (including any software, code, file or program) which may: prevent, impair or otherwise adversely affect the operation, accessibility, performance or availability of any computer software, hardware or network, any telecommunications service, equipment or network or any other service or device.

The Customer shall not, except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties and except to the extent expressly permitted by Pincites:

The Customer shall use all reasonable endeavors to prevent any unauthorized access to, or use of, the Services and, in the event of any such actual or suspected unauthorized access or use, shall promptly notify Pincites.
